The present terms and conditions for the provision of vacation rental services establish the contractual basis between California Dream Inn, hereinafter referred to as “Company” or “CDI”, and the client guest accountable for the reservation, hereinafter referred to as “Client”, “Customer” or “Guest”. The client is accountable and liable for acts of the whole group that is with him, despite all guests being jointly responsible for the reservation.
To make a vacation rental reservation, hereinafter referred to as “reservation”, the client declares to accept in full the present contractual conditions, which shall constitute the vacation rental agreement.
1. Online reservations
The California Dream Inn websites (https://californiadreaminn.bookeddirectly.com/ and https://www.californiadreaminn.pt/) enable you (also referred to as “customer” hereafter) to check the accommodation offerings and availability of Vacation Rentals and submit an online reservation request. On completion of the reservation process, the Reservations Management System will transmit an online or email confirmation of your reservation. A reservation is only valid when a confirmation e-mail has been received by the customer. Additional products, services, special requests or accommodation must be requested and confirmed by the customer directly with a California Dream Inn representative including, for example: extra bedding, baby bed, highchair, etc.
2. Rental Prices
The prices indicated on the California Dream Inn website or communicated via e-mail or telephone by a CDI representative for products and services are subject to availability. Taxes and service charges are only included if indicated in the rate policy.
3. Payment
It will be necessary for you to provide credit card details to secure a reservation. Processing of payment information is handled via the third-party payment service provider Stripe. Stripe has been audited and certified as a PCI compliance Level 1 service provider, which means it must undergo an annual compliance report and routine security scans and tests. Stripe encrypts all customers’ credit card numbers and stores decryption information separately. The payment details may then be used by CDI for payment of a deposit (if any) as advised at the time of booking or as a guarantee for a future payment, in the case of a no-show, a cancellation or change to the reservation.
4. Cancellations and Amendments
Typically, CDI’s standard cancellation policy is as follows:
For apartment vacation rentals, to receive a full refund, you must cancel at least 14 days before check-in. If you cancel between 7 and 14 days before check-in, you will be refunded 50% of the total. Less than 7 days before check-in, no refund.
For villa vacation rentals, to receive a full refund you must cancel at least 30 days before check-in. If you cancel between 14 and 30 days before check-in, you will be refunded 50% of the total. Less than 14 days before check-in, no refund.
You should make any cancellations or amendments to your reservation using the same CDI channel through which you booked, either online, email or by telephone. The cancellations and amendments policy that applies to your reservation will depend on the respective policy as advised at the time of booking.
5. Rate/Reservation Validity
Reservation confirmations are provided to you solely for your convenience. CDI retains official records of reservation transactions, including details of dates of stay and room, product and/or service rates. In the event of discrepancies, alterations, modifications, or variations between this confirmation and our official records, CDI’s official records shall prevail. Tampering with this confirmation to alter any room, product or service rate or any other reservation information is strictly prohibited and will have legal consequences.
6. Early Departure
There are no full or partial refunds in the event of early departure.
7. Currency
Reservations will be charged in the property’s local currency (EUR) as shown on the CDI website or given over e-mail or telephone at the time of booking. If payment occurs in another currency, a foreign currency transaction may be charged by your card provider.
A refund of a deposit or prepayment, if any, will be subject to the exchange rate applied by your payment card provider at the time of any such refund and may differ from the exchange rate applied at the time such deposit or prepayment was made.
8. Guarantee Rules
For reservations guaranteed with a credit card at the time of making your reservation, rooms are held until the property’s check-out time on the day following the day of arrival. Rooms, products or services booked with an invalid credit card are subject to immediate cancellation.
9. Overbooking
In the event that a guest cannot be accommodated due to the unlikely event of an overbooking or an unforeseen circumstance, CDI will attempt to accommodate guests, at its expense, at a comparable property in the area for the night(s) for which CDI is unable to accommodate such guests.
10. Special Requests
CDI will strive to honour any request for specific room types, bed types, other special requests and will confirm such arrangements at the time you make your request or reservation. Until specific confirmation is issued then your request cannot be guaranteed.
11. Pets
NO PETS. All properties have a strict no pets policy. Except for service animals or approved support animals for persons with disabilities, no pets are allowed (even temporarily) anywhere in or about the rental property without prior written authorization from CDI. Care and feeding of stray or unauthorized animals or pets is prohibited. If an animal has been on the premises of the rental property, deodorizing and/or deep cleaning will be required to protect future renters from possible health hazards. If you or any occupant is found to be in possession of any prohibited animal(s), the customer may be charged a fee of no less than 200 Euro per incident and may result in immediate cancellation of your reservation.
12. Functions
Parties, events, and large gatherings of any kind (for example, bachelor, bachelorette, stag, on-site weddings, etc.) are strictly prohibited at the Vacation Rental. Any small gathering must comply with house rules which are set regarding Noise, the Neighborhood and Visitor numbers.
13. External services
The CDI property at which you stay may advertise the opportunity to purchase products or services from independent third-party suppliers (“independent suppliers”) including, by way of illustration only and without limitation, excursions, charters, surf lessons, etc. (“external services”). The following provisions apply to all external services:
(i) All information on the CDI website or otherwise communicated by CDI regarding external services has been provided to CDI by the independent suppliers. Such information does not constitute any endorsement or recommendation of the external service by CDI and is for general guidance only. CDI does not make any representation or warranty, express or implied, as to the nature, quality, cost or any other aspect of the external services and it is your responsibility to check all relevant details of the external services with the independent supplier prior to purchase or booking.
(ii) CDI acts solely as intermediary introducing independent suppliers. Your contract for any external services will be made direct with the relevant independent supplier and CDI does not have any other involvement in or control over the provision of external services. Consequently, CDI will not have any liability to you for the warranties, representations, acts, errors, omissions, breaches or negligence of any independent supplier or for any accidents, personal injuries, death, loss of or damage to property or any other losses, damages, costs or expenses resulting, directly or indirectly, from your purchase or use of any external service, to the fullest extent permitted under applicable laws.
It is your responsibility to check that, where appropriate, the independent supplier has adequate public liability insurance for the external service and/or to ensure that you and any dependents or associates using the external service have adequate personal insurance cover against all foreseeable risks.
14. Obligations of the Customer (Guest)
You (the customer) agree to the terms and conditions imposed by CDI including the adherence to House Rules (provided electronically on our website and provided in hardcopy format located inside the vacation rental). You also agree that you are fully responsible and shall pay for all charges, fees, duties, taxes, assessments and other amounts arising out of your reservation when due, including additional taxes and fees that may not be included in the quoted rate.
You understand that any violation of CDI’s conditions may result in cancellation of your reservation and you forfeiting any monies paid for such reservation.
15. Arrival procedure at check-in
The check-in time is between 4pm and 9pm. However, depending on availability, it is possible to make an early check-in or a late check-in, however this must be requested to and confirmed by CDI at least 24 hours prior to arrival. A CDI representative will meet you at the property at time of check-in to perform a quick walk-through, explain any key details of the property and answer any questions. If check-in is made via remote access such as key lock-box or entry code, CDI will be available for assistance via the phone number provided under “Contact Details” section below. A phone call, message or a visit will be made the following day with the purpose of answering any questions or address any special needs / requests.
Under the laws in force in Portugal, the foreign clients are as of now informed that they should present at the check-in an identification document - Passport or Citizen Card / Driving License for citizens UE citizens, whose identification data have to be communicated by the company to the Foreigners and Borders Service (SEF).
16. Departure procedure and check-out
The customer must check-out and leave the accommodation until 11:00am (or until 10:00am for Casa Infinita). Depending on availability, it is possible to make a late check-out, however this must be requested to and confirmed by CDI at least by 11am on day prior to departure date.

When check-out is performed solely by the customer, CDI will conduct a subsequent verification of the accommodation. If any excess damages are noted, a report will be sent to the client of damage encountered as well as their appreciation for the purposes of compensation.
17. Privacy and data protection
Our Reservation Privacy Policy (set out below) will apply to your reservation and forms part of these Reservation Terms and Conditions.
Your privacy is important to us. This notice applies to all information collected or submitted on the CDI websites and/or email. CDI uses a secure server to ensure all client information is safe. All client’s information is kept in-house and strictly confidential. The personal information collected from you during reservation processing (name, address, phone numbers, email address, etc.) is used exclusively for contract and reservation purposes. We do not share this information with outside parties except to the extent necessary to complete that reservation with Stripe the third party payment processing platform (as mention above in the “Payment” section). Lastly, we use email addresses to answer inquiries received and send out CDI newsletters if the customer opts-in.
18. Intellectual Property Rights
‘California Dream Inn’ has trademark protection. Any copyright and other intellectual property in the content and materials on the CDI website remains with CDI. Downloading, copying or otherwise using any material on the CDI website is permitted only for private use and limited to the sole purpose of making a CDI reservation.
19. Force Majeure
CDI will not be liable for any change or cancellation of any reservation that is caused, in whole or in part, by events, occurrences, or causes beyond the control of CDI. Such events, occurrences, or causes include, without limitation, acts of God, terrorist activities, weather, strikes, lockouts, riots, acts of war, earthquake, volcanic activity, ash clouds, tsunamis, fire and explosions.
20. Limitations
CDI nor other providers of products or services related to the reservations platform are responsible for communication malfunctions, failures, difficulties or lost, stolen, or misdirected transmissions, messages or entries, or the security of any such communications to the fullest extent permitted under applicable laws. Further, CDI nor any other providers of products or services related to the reservations platform are responsible for incorrect or inaccurate entry information, whether caused by user(s), by any of the equipment or programming associated with the reservations platform, or by any technical or human error that may occur in the processing of any information related to the reservations platform and shall not be liable for damages resulting from any of the foregoing to the fullest extent permitted under applicable laws.
CDI may cancel or modify reservations where it appears that a user has engaged in fraudulent or inappropriate activity or under other circumstances where it appears that the reservations contain or resulted from a mistake or error.
21. Governing Law and Conflict Resolution
In the event of conflicts or disputes related to this contract or related to it, the parties agree henceforth to use mediation in the first instance and, if this proves to be inconclusive, the arbitration of the Chamber of Commerce of Lisbon, which will exclusively apply its regulation, as well as the Portuguese law applicable to the matter, with the costs being the loser party’s responsibility.
